Haverly (“we”, “us”, or “our”) operates this store and website, gethaverly.com (the “Site”), including all related information, content, features, tools, products, and services, in order to provide you, the customer, with a curated shopping experience (the “Services”). Haverly is powered by Shopify, which enables us to provide the Services to you. This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase or other transaction using the Services or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

Please read this Privacy Policy carefully. By using and accessing any of the Services, you acknowledge that you have read this Privacy Policy and understand the collection, use, and disclosure of your information as described here.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the revised Privacy Policy on the Site, update the “Last updated” date, and take any other steps required by applicable law.

Personal Information We Collect or Process

When we use the term “personal information,” we are referring to information that identifies or can reasonably be linked to you or another person. Depending on how you interact with the Services, where you live, and as permitted or required by applicable law, we may collect or process the following categories of personal information, including inferences drawn from it:

  • Contact details including your name, address, billing address, shipping address, phone number, and email address.
  • Financial information including payment card information, transaction details, form of payment, payment confirmation, and other payment details.
  • Account information including your username, password, preferences, and settings.
  • Transaction information including the items you view, put in your cart, purchase, return, or cancel, and your past transactions.
  • Communications with us including information you include in customer-support inquiries, reviews, or survey responses.
  • Device information including information about your device, browser, network connection, IP address, and other unique identifiers.
  • Usage information including how and when you interact with or navigate the Services.

We collect personal information: directly from you (when you place an order, create an account, communicate with us, or otherwise provide it); automatically through the Services (from your device, using cookies and similar technologies); from our service providers (when we engage them to enable technology or they collect or process information on our behalf); and from our partners or other third parties.

How We Use Your Personal Information

Depending on how you interact with us, we may use personal information for the following purposes. In addition to the specific uses below, we may use information we collect about you to communicate with you, provide or improve the Services, comply with applicable legal obligations, enforce applicable terms of service, and protect or defend the Services, our rights, and the rights of our users or others.

  • Providing products and services. To process payments, fulfill and ship orders, manage subscriptions, send notifications related to your account, purchases, returns, or exchanges, create and maintain your account, arrange shipping, facilitate returns and refunds, and enable reviews.
  • Marketing and advertising. To send marketing, advertising, and promotional communications by email, text message, or postal mail, and to show you advertisements for products or services, including tailoring advertising on our Site and other websites. If you are an EEA or UK resident, the legal basis for these activities is our legitimate interest in selling our products, according to Art. 6 (1) (f) GDPR.
  • Security and fraud prevention. To detect, investigate, and take action regarding possible fraudulent, illegal, or malicious activity. If you register an account, you are responsible for keeping your credentials safe; we recommend not sharing them, and you should contact us immediately if you believe your account has been compromised. If you are an EEA or UK resident, the legal basis is our legitimate interest in keeping our website secure, according to Art. 6 (1) (f) GDPR.
  • Communicating with you and service improvement. To provide customer support and improve the Services, in our legitimate interest in being responsive to you and maintaining our business relationship, according to Art. 6 (1) (f) GDPR.

Cookies

Like many websites, we use cookies on our Site to power and improve the Site (including remembering your actions and preferences), to run analytics, and to better understand user interaction with the Services. We may permit third parties and service providers to use cookies on our Site for analytics and advertising, including to tailor advertising on other websites. Most browsers automatically accept cookies, and you can choose to set your browser to remove or reject cookies through its controls. Removing or blocking cookies can negatively impact your user experience and may cause some features not to work correctly or become unavailable, and blocking cookies may not completely prevent how we share information with third parties such as our advertising partners.

How We Disclose Personal Information

In certain circumstances, we may disclose personal information to third parties for legitimate purposes subject to this Privacy Policy, including the following categories of recipients:

  • Vendors and third parties who perform services on our behalf (such as Shopify, Internet service providers, payment processors, fulfillment partners, customer-support partners, and data-analytics providers).
  • Business and marketing partners, including advertising services, to provide advertising and marketing services to us.
  • Affiliates within our corporate group.
  • In connection with a business transaction such as a merger or bankruptcy; to comply with applicable legal obligations (including responding to subpoenas, search warrants, and similar requests); to enforce applicable terms of service; and to protect or defend the Services, our rights, and the rights of our users or others.

Over the preceding 12 months, we have disclosed the following categories of personal information for the purposes described above: identifiers (such as basic contact details and certain order and account information); commercial information (such as order information, shopping information, and customer-support information); and Internet or other similar network activity (such as usage data) — in each case to vendors who perform services on our behalf, business and marketing partners, and affiliates.

We do not sell personal information in exchange for money, and we do not sell or share telephone numbers. However, our use of advertising and analytics partners — for example, ad platforms that match customers using identifiers such as hashed email addresses — may be considered “sharing” or a “sale” as those terms are defined under certain U.S. state privacy laws. On that definition, over the preceding 12 months we have “shared” for advertising and marketing activities: identifiers such as name and email address (including in hashed form as ad-matching keys); commercial information such as records of products purchased; and usage data — in each case with business and marketing partners. You can opt out of this sharing at any time via our Your Privacy Choices page. We do not use or disclose sensitive personal information without your consent or for the purpose of inferring characteristics about you.

Third-Party Websites and Links

Our Site may provide links to websites or other online platforms operated by third parties. If you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on them. Providing personal information on public or semi-public venues, including information you share on third-party social networking platforms, may make that information viewable by other users of those platforms.

Children’s Data

The Services are not intended to be used by children, and we do not knowingly collect any personal information about children. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details below to request that it be deleted. As of the effective date of this Privacy Policy, we do not have actual knowledge that we “share” or “sell” (as those terms are defined in applicable law) the personal information of individuals under 16 years of age.

Security and Retention of Your Information

Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee “perfect security.” Any information you send to us may not be secure while in transit, and we recommend that you do not use insecure channels to communicate sensitive or confidential information to us. How long we retain your personal information depends on factors such as whether we need it to maintain your account, to provide the Services, to comply with legal obligations, to resolve disputes, or to enforce applicable contracts and policies.

Your Rights and Choices

Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. However, these rights are not absolute, may apply only in certain circumstances, and, in certain cases, we may decline your request as permitted by law.

  • Right to access / know the personal information we hold about you, including details of how we use and share it.
  • Right to delete personal information we hold about you.
  • Right to correct inaccurate personal information.
  • Right of portability — to receive a copy of your personal information and, in certain circumstances, to request that we transfer it to a third party.
  • Right to opt out of sale, sharing, or targeted advertising. You may direct us not to “sell” or “share” your personal information, or opt out of processing considered “targeted advertising,” as defined in applicable privacy laws, by visiting our Your Privacy Choices page. If you visit our Site with the Global Privacy Control opt-out preference signal enabled, we will automatically treat this as a valid opt-out request for the device and browser you used. Other than the Global Privacy Control, we do not recognize other “Do Not Track” signals.
  • Restriction of processing / withdrawal of consent, where applicable law provides these rights.
  • Right to appeal our decision if we decline to process your request.
  • Managing communication preferences. We may send you promotional emails, and you may opt out at any time using the unsubscribe option in our emails. If you opt out, we may still send you non-promotional emails, such as those about your account or orders.

You may exercise these rights by emailing hello@gethaverly.com. We will not discriminate against you for exercising any of these rights. We may need to collect information from you to verify your identity, such as your email address or account information, before providing a substantive response. In accordance with applicable laws, you may designate an authorized agent to make requests on your behalf; before accepting such a request, we will require the agent to provide proof of authorization, and we may need you to verify your identity directly with us. We will respond to your request in a timely manner as required by applicable law.

SMS Privacy Statement

If you provide your mobile phone number and opt in to receive SMS or MMS communications from Haverly, we will use your number solely to deliver transactional, informational, or promotional messages that you have explicitly agreed to receive. Text-messaging originator opt-in data and consent will not be shared with any third parties, except as necessary to provide the SMS service (such as with platform providers and aggregators). Mobile phone contact information will not be shared, sold, rented, or otherwise disclosed to third parties for their own marketing or promotional purposes. You may opt out of SMS/MMS communications at any time by replying STOP to any message; reply HELP or contact hello@gethaverly.com for assistance.

International Users

Please note that we may transfer, store, and process your personal information outside the country you live in. Your personal information is also processed by staff and third-party service providers and partners in these countries. If we transfer your personal information out of Europe or the UK, we will rely on recognized transfer mechanisms such as the European Commission’s Standard Contractual Clauses or equivalent contracts issued by the relevant UK authority, unless the transfer is to a country determined to provide an adequate level of protection.

Complaints

If you have complaints about how we process your personal information, please contact us using the details below. If you are not satisfied with our response, depending on where you live you may have the right to appeal our decision or to lodge a complaint with your local data-protection authority.
